Benefits repayment agreements are helpful for Employers to recoup payments made by the Company while an Employee was on a Leave of Absence.

Ideally, Employees on any type of leave should be required to make timely (Pay-as-you-go) payments for their EE premiums. However, in cases where this is not established and the Company pays 100% of the premium, a written authorization is often required to recoup the EE’s share/debt once they return to work.

State laws strictly regulate the deduction from pay, which is why Employers must tread carefully. For many states, a voluntary written authorization is required. Use this week’s HR Form of the Week to keep on file for such scenarios. As always, consistency is key, so be sure to apply uniformly for all leave scenarios.
