It is critical for all organizations to correctly determine whether an individual providing services are employees or independent contractors to avoid misclassification issues that can lead to legal and financial consequences. Employers that misclassify employees as independent contractors may be liable for income tax withholdings, unpaid wages and wage-related penalties, state disability and unemployment insurance contributions, workers’ compensation insurance premiums, liability to employees and third parties for workplace injuries, as well as other civil penalties and fines.
This weeks HR Form of the Week will help analyze whether an individual qualifies for independent contractor status, or if they should be classified as an employee.
